We refer to the above matter weherin we act for Mr Sivalingam a/l Pathiapan of Lot 27 No.49, Jalan Air Madu, Air Panas, Setapak 53200 Kuala Lumpur and also Mr. Velu a/l Pathiapan and Mr. Paramasivam.
At about 1.30 pm today our client, Mr Sivalingam a/l Pathiapan, the resident priest of Sri Siva Bala Muniswarar Hindu Temple in Setapak and the two (2) other devotees abovenamed were working at their aforesaid temple when suddenly all three (3) were arrested by plain clothes policemen, handcuffed and dragged to the Sentul police station in an unmarked car.
Despite Mr Sivalingam a/l Pathiapan agreeing to follow (under protest) the said civil clothes policeman Lance Corporal Mutalib insisted in handcuffing Mr Sivalingam a/l Pathiapan. Mr Sivalingam a/l Pathiapan protested and said that he was the resident priest of the said temple and yet Mr Sivalingam a/l Pathiapan was handcuffed in the presence of the other devotees and members of the public.
The said arresting policeman refused to identify himself or show his authority card or the reason for the arrest contrary to Article 5(3) of the Federal Consitution.
Mr Sivalingam a/l Pathiapan immediately telephoned and spoke to our Mr.P.Uthayakumar who got to speak to the said policeman one Lance Corporal Mutalib who confirmed that all the said three (3) persons were mere suspects and would be taken to the Sentul police station and nothing incriminating was found on them. He refused to say anything else, name the Investigating Officer or give his handphone number.
We protest this unlawful and arbitrary arrest and ask that all the said three (3) persons be released immediately. Should your goodselves proceed to detain them any further kindly let us know the date, time and the court they would be produced in order for us to be present and represent them accordingly.
Our client instructs us that all of them have been arrested and detained arising out of their thirty (30) over police reports (No.Setapak/006004/06 dated 8/6/2006) and others when their said temple was demolished by the Dewan Bandaraya Kuala Lumpur (DBKL) and aided and abetted by the Sentul police.
Mr Sivalingam a/l Pathiapan has even lodged a police report that he received a threatening phone call to kill him if he does not vacate the land the temple is sitting on. No action has been taken on all this said thirty (30) over police reports despite the very serious crimes committed.
Thereafter our client had been continuously harassed by the developer and DBKL to move out of the said land where the demolished and now rebuild temple is sitting on.
Yesterday DBKL officials, Federal Territory land officials and the developers came by and again told Mr Sivalingam a/l Pathiapan to vacate the said temple.
Please take note that a High Court Criminal Miscellaneous application has been filed at the Kuala Lumpur High Court vide Court Case No. 44-152 –2006 and is fixed for hearing on 26/3/2007.
Our clients would pursue in Court any attempts to subvert the cause of justice, any arbitrary and unlawful tactics by your goodselves.
