AG:Don’t prosecute Tian Chua- double standards

1. PROSECUTING TIAN CHUA FOR ATTEMPTED MURDER AN ABUSE OF POLICE/PROSECUTION POWERS/VINDICTIVE/MALA-FIDE.

2. DOUBLE STANDARDS: NO POLICE PERSONNEL EVER CHARGED FOR THE ACTUAL MURDERS LATEST BEING ON 8/3/2007.

3. ENFORCEMENT PERSONNEL/BULLDOZER DRIVERS NEVER ARRESTED NOR CHARGED FOR ATTEMPTED MURDER.

With all due respect may we refer to the above matter. We hereby appeal that your goodselves consider not prosecuting Tian Chua for attempted murder as investigated by the police as the same may be perceived by the public to be abuse of police/prosecution powers, vindictive and mala-fide.

To start off with the colour pictures in the News Straits Times 9/3/2007 at pg 8, especially picture No.3 is an attempt to show someone in pain after being “pinned” under Tian Chua’s car.

We beg to differ as it is clear that at least one other person is standing right in the middle of the very same car but he is not “grimacing in pain” at all. All other five (5) onlookers are looking at the said man allegedly “pinned”.

They should instead be looking at Tian Cua to warn him to back off. It is plain and obvious from the said picture alone that the said man assisted by the other five (5) deliberately put himself in the path of way of Tian Chua to stop him from going to the aid of the poor, defenceless, homeless and helpless squatters of Kg.Berembang who were literally fighting the weight and might of the whole state machinery to save their homes.

This man should instead have been investigated and charged for endangering his own life or attempting to take his own life. These pictures are an attempt by the authorities to distract attention from the real state atrocities against the squatters and homeless of Kg Berembang.

The very same News Straits Times today at page 23 reported “Burglary suspect killed after cops return fire”. We ask once again: why wasn’t this said suspect shot in the leg, captured alive and tried in a Court of law? Summary Justice? Both bullets which hit the deceased were to his right thigh and his ribs. The police murderer/s of this suspect was never arrested or remanded nor is there any indication to charge him for murder unlike Tian Chua’s case. Hundreds of other such victims have been shot dead in vain and injustices seen.

The Report of the Royal Commission on the Police at pages 72 to 87 have outlined 80 cases of death in police custody from the year 2000 to 2004 but only one policeman had been investigated and actually prosecuted for murder. Why the doubled standards?

In the case of the demolishment of the Setapak Hindu temple on 8/6/2006 the temple’s lawyer was almost run over and killed by the bulldozer when the driver saw the lawyer climbing up the bulldozer asking for the Court Order authorising the demolishment.

The resident priest’s brother was attacked by a group of about 15 policemen and was hit on the head with a handcuff used as a knuckle duster and bled profusely. The priest’s mother’s hand was broken when she threw curry powder on a policeman’s eyes in defending her temple from criminal trespass, criminal damage, defiling a place of worship, disturbing a religious assembly and most importantly her Constitutional Right to Freedom of Religion pursuant Article 11. Four human rights defenders and their lawyer were instead arrested and imprisoned.

One police report was lodged specifically alleging attempted murder by the said bulldozer driver and at least thirty (30) other police reports were lodged but there was no arrest or prosecution of the brutal state authorities.

Why the pin drop silence?
