We refer to the above matter wherein we act for Mr. Uthayakumar a/l Ponnusamy of No. 10-4-4, Tivoli Villas, Jalan Medang Tanduk, Bukit Bandaraya, 59100 Kuala Lumpur.

Please be informed that on 18.12.2006 our client had filed a suit at the Kuala Lumpur High Court (Criminal Division) (copy enclosed) against Y.A.B. Dato’ Seri Khir Toyo and 9 others for amongst others.

Prayer 13     “Satu Perintah bahawa bermula dari tarikh pemfailan tindakan/guaman ini sehingga ke tarikh keputusan muktamad tindakan/guaman ini Responden-Responden dan/atau ejen/pengkhidmat/pekerja mereka adalah di larang daripada merobohkan mana-mana kuil Hindu dan/atau memecahkan Dewa-dewa di mana-mana kuil Hindu di Malaysia”.

Prayer 14       “Satu Perintah bahawa mana-mana Responden yang merobohkan sebarang Kuil Hindu dan/atau memecahkan Dewa-dewa di mana-mana kuil  Hindu di Malaysia dari tarikh pemfailan disini sehingga ke tarikh keputusan muktamad tindakan/guaman ini adalah wajib dikenakan perintah pengkomitan penjara selama sekurang-kurangnya enam (6) bulan oleh Mahkamah yang Mulia ini”.

The filing of this High Court proceedings was widely published in the local media and your goodselves are deemed to have notice of the same. Despite this we have been informed by our clients that your goodselves have vide letter entitled “Arahan Pemindahan Kuil Sediada ke Tapak Kompleks Rumah Ibadat Bukan Islam Seksyen 18, Shah Alam” dated 19/1/2007 given notice to relocate the Sri Mahamariamman Hindu Temple in Jalan Tarian 11/12, Seksyen 11, 40000 Shah Alam, the Sri Mahamariamman Hindu Temple in Jalan Joran 19/24, Seksyen 19, 40000 Shah Alam and the Sri Mahamariamman Hindu Temple in Seksyen 15, 40200 Shah Alam.

An appeal has been made to your goodselves via letter dated 3/11/2006 from the Hindu Rights Action Force (Hindraf), a Non-Governmental Organisation, amongst others that the land on which these (3) temples including that of the Sri Kaliaman Hindu Temple in Section 18, the  Sri Vinayagar Hindu Temple in Section 18 and the Sri  Mariaman Hindu Temple in Section 18 are occupying are granted/alienated to their respective trustees in compliance with Article 11 (Freedom of Religion) and Article 8 (Equality before the Law) of the Malaysian Federal Constitution within the date therein.

Please Take Final Notice that should your goodselves proceed to demolish the Sri Mahamariamman Hindu Temple in Jalan Tarian 11/12, Seksyen 11, 40000 Shah Alam, the Sri Mahamariamman Hindu Temple in Jalan Joran 19/24, Seksyen 19, 40000 Shah Alam and the Sri Mahamariamman Hindu Temple in Seksyen 15, 40200 Shah Alam, our client would be left with no alternative but to proceed with contempt of court proceedings against your goodselves.
